Returns & Right of Withdrawal
The following information summarises important consumer rights under German law, in particular the German Civil Code (BGB) and the Act on Off-Distance Contracts (FAGG), which implements EU Directive 2011/83/EU on consumer rights. It does not replace individual legal advice. For binding conditions, the information provided at the pharmacy and on your purchase receipt or separate distance-selling terms apply.
1. Purchases at the pharmacy (on site)
When you buy products such as BioEssence directly at Apotheke am Park, Dr. Ralph-Rainer Richter e.K., Hauptstraße 8, 04416 Markkleeberg, Germany, the statutory rules for over-the-counter sales apply. There is generally no fourteen-day right of withdrawal for contracts concluded in person at the pharmacy counter in the same way as for distance or off-premises contracts under Sections 312g, 355 BGB.
Whether a return or exchange is possible for goodwill reasons is decided by the pharmacy in accordance with its internal policy and applicable law (e.g. food law, hygiene, product safety). Please keep your receipt and the original packaging.
2. Distance contracts (online or telephone)
If the pharmacy offers distance selling (e.g. web shop or telephone order) and you are a consumer within the meaning of Section 13 BGB, you generally have a right of withdrawal of fourteen days without giving reasons. The period begins after the day on which you or a third party named by you (not the carrier) took possession of the goods, unless a different starting point applies under Sections 356 et seq. BGB.
To exercise your right, you must inform us of your decision to withdraw by an unequivocal statement (e.g. letter or email). You may use the model withdrawal form referred to in Section 356(2) BGB; the pharmacy will provide the exact text before or after conclusion of the contract if distance selling is offered.
Consequences of withdrawal: If you withdraw, we will reimburse all payments received from you, including delivery costs (except for additional costs if you chose a delivery method other than the cheapest standard offer), without undue delay and at the latest within fourteen days from the day we received notice of your withdrawal. We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever is earlier. You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you communicate your withdrawal. You bear the direct cost of returning the goods unless otherwise agreed or we failed to inform you that you must bear those costs.
3. Exceptions to the right of withdrawal (sealed goods)
For distance contracts, the right of withdrawal may expire early for certain goods. Relevant for food supplements (including capsules) is in particular Section 312g(2) No. 3 BGB: the right of withdrawal does not apply to contracts for the supply of goods which, for reasons of health protection or hygiene, are not suitable for return if their seal was removed after delivery.
This means: if you open safety seals or packaging in a way that makes hygienic resale impossible, your withdrawal may be excluded or your claim to reimbursement may be reduced in line with statutory rules on diminution in value (Section 357(7) BGB, Section 357(8) BGB).
Further exceptions under Section 312g(2) BGB (e.g. sealed audio/video/software if seal removed) are listed in the law and may be referred to in the pharmacy’s pre-contractual information if applicable.
4. Non-conformity and warranty
Statutory rights in case of defects (Gewährleistung) under the BGB and, for consumers, the rules on sales in Sections 474 et seq. BGB remain unaffected. The limitation period for claims for defects is generally two years from delivery of the goods for consumers, subject to special rules for certain items.
5. Voluntary returns (goodwill)
Any voluntary return policy beyond the statutory minimum is offered at the discretion of the pharmacy and only within the framework communicated at the point of sale or in separate terms.

7. Consumer information and dispute resolution
Consumer centres in Germany (Verbraucherzentrale) provide free or low-cost guidance. The European Commission’s ODR platform for online disputes: https://ec.europa.eu/consumers/odr/. Participation in alternative dispute resolution before a consumer arbitration body is voluntary unless we are required to participate in a specific sector.
